We noticed recently that another firm saw fit to boast about settling a claim for one million pounds on behalf of a client who had left employment. Our record is 3 times that in respect of the termination of someone’s employment and we regularly negotiate severance packages between £20,000 and £500,000. In calculating the settlement amount one has to take into account, notice, unfair dismissal, share options, pension loss, bonus, commission, phantom share schemes and such like, health insurance, car or car allowance, private petrol, other benefits and the length of time a fair procedure might take. Also important when dealing with a settlement agreement will be restrictive covenants, reason for leaving, reference, and the tax indemnity.
In 2018 our record was about £4.25million for a departing executive but that was exceptional.
We also regularly work for companies both large and small. One of our listed company clients asked us to draft new service agreements for its main board directors. We have also completed a handbook review for a television channel in London and advised on redundancy procedures for a telecoms company.
